Section 208 of the Indian Succession Act, 1925, provides that the lineal descendants of a person who dies intestate shall be entitled to a share of the property. The section reads: "The lineal descendants of the intestate shall be entitled to a share of the property, which shall be distributed among them in the following manner: (a) the children of the intestate shall take equally, (b) the grandchildren of the intestate shall take equally, and (c) the great-grandchildren of the intestate shall take equally." This section applies to all persons who die intestate, and have lineal descendants. The share of the lineal descendants is based on the rules of succession provided in the Act, which take into account the degree of relationship between the deceased and the claimants. The key judicial interpretation of this section is that the lineal descendants take the property in the order specified in the section.
