Statutory Content of Section 204

Section 204 of the Indian Succession Act, 1925, provides that the property of a person who dies intestate, and has an illegitimate child, shall be distributed according to the provisions of this Act. The section reads: "The property of a person dying intestate shall be distributed in the following manner: (b) if the intestate has left an illegitimate child, the property shall be distributed between the illegitimate child and the other heirs according to the provisions of this Act." This section applies to all persons who die intestate, and have an illegitimate child. The distribution of the property is based on the rules of succession provided in the Act, which take into account the degree of relationship between the deceased and the claimants. The key judicial interpretation of this section is that an illegitimate child has a right to inherit the property of the intestate, but only to the extent provided by the Act.
