Statutory Content of Section 202

Section 202 of the Indian Succession Act, 1925, provides that the property of a person who dies intestate, and is not a Muslim, shall be distributed according to the provisions of this Act. The section reads: "Save as otherwise expressly provided in this Act, the distribution of the property of the intestate, whether a male or female, dying after the commencement of this Act, shall, if such intestate is not a Muslim, be regulated by this Act." This section applies to all persons who are not Muslims, including Hindus, Christians, Jews, and Parsis. The distribution of the property is based on the rules of succession provided in the Act, which take into account the degree of relationship between the deceased and the claimants. The key judicial interpretation of this section is that the Indian Succession Act applies to all non-Muslims, and its provisions override any personal law or custom that may be applicable.
