Statutory Content of Section 90

Consent known to be given under fear or misconception; unless the contrary appears from the context, consent is such a consent as is intended by the section to which it occurs, if it is given by a person under fear or misconception, or given under a mistake of fact, and if the person from whom the consent is derived has, at the time when the consent is given, the knowledge or reasonable belief that it was given under fear or misconception, or under a mistake of fact, the consent is not such a consent as is intended by that section.
