If the offender is himself the aggressor, and, having used violence in the exercise of the right of private defence, he is assaulted by the person whom he has injured, or by any other person acting on behalf of that person, the exercise of the right of private defence by the offender does not commence until he has retreated as far as possible from the person against whom he was exercising the right of private defence, and has also, if it is possible for him to do so, made it clear to that person that he intends to discontinue his defence. Notwithstanding this, the right of private defence shall continue if the assault on the offender is a deadly assault, and if there is risk of harm to an innocent person from the continuance of the assault.
