Statutory Content of Section 91

Section 91 of the Indian Contract Act, 1872, provides an explanation for certain terms used in the Act. It states that where a person is convicted of an offence and is sentenced to imprisonment, the term 'imprisonment' in relation to such person includes transportation or confinement awarded in addition to or instead of imprisonment. The section aims to clarify the meaning of specific terms to avoid confusion and ensure consistency in the application of the law. The actual statutory language of this section is: 'The expressions "transportation" and "imprisonment" in sections 51, 52, 129, 130, 131, 140 and other sections of the Indian Penal Code, and in section 106 of the Code of Criminal Procedure, 1973, include transportation or confinement awarded in addition to or instead of imprisonment.' Judicial interpretations have emphasized the importance of understanding these terms in the context of contractual obligations and their implications on the parties involved.
