Section 87 of the Indian Contract Act, 1872, deals with the revocation of a continuing guarantee upon the death of the surety. The section states: 'The death of the surety operates, in the absence of any contract to the contrary, as a revocation of a continuing guarantee, as to future transactions.' This implies that unless there is an agreement to the contrary, the death of the surety automatically revokes a continuing guarantee, but only with respect to future transactions. The guarantee remains in effect for any transactions that occurred before the surety's death. This provision ensures that the creditor is aware of the change in circumstances and cannot assume that the guarantee continues indefinitely after the surety's death.
