धारा 68

Section 68 of the Indian Contract Act, 1872, provides that when a person signifies his acceptance of a proposal by performing, or offering to perform, the conditions precedent to the proposal, such performance or offer is deemed to be an acceptance of the proposal. The section further provides that this provision shall not apply if the performance or offer is made with the intention of doing an act different from what the proposer contemplated. The Madras High Court has held that the performance or offer to perform the conditions precedent must be made with the intention of accepting the proposal. (Ramaswami v. Rangaswami, AIR 1961 Mad 241).
