Statutory Content of Section 145

Section 145 of the Indian Contract Act, 1872, states that 'no consideration is necessary to create an agency.' This means that an agency can be created without the need for consideration. The section emphasizes the distinction between an agency and a contract, as an agency is a relationship where one person acts on behalf of another, whereas a contract is an agreement between two or more parties. The courts have interpreted this section to mean that an agency can be created by a mere agreement between the principal and the agent, without the need for consideration. For example, if a person asks another to purchase goods on his behalf, an agency is created, even if no consideration is paid to the agent.
