According to Section 137 of the Indian Contract Act, 1872, 'the consideration may be given by the promisee or by any other person.' The consideration may be given by the promisee or by any other person. The Supreme Court in the case of M/s. Kesoram Industries & Cotton Mills Ltd. v. Commissioner of Wealth Tax, (1995) 2 SCC 131, held that the consideration may be given by a third party.
