According to Section 45 of the Sale of Goods Act, 1930, '(1) where the seller has exercised his right of lien or stoppage in transit, he may re-sell the goods, and, if the buyer has paid any part of the price, the re-sale shall be subject to a credit of such part of the price. (2) where the seller has not exercised his right of lien or stoppage in transit, the buyer shall, if the buyer has paid any part of the price, be entitled to re-delivery of the goods, or, if the goods have been re-sold, to the delivery of the proceeds of the re-sale, subject to a credit of such part of the price.'
