Section 203

Section 203 of the Indian Succession Act, 1925, provides that the property of a person who dies intestate, and leaves behind a spouse, shall be distributed according to the provisions of this Act. The section reads: "The property of a person dying intestate shall be distributed in the following manner: (a) if the intestate has left a spouse, the property shall be distributed between the spouse and the other heirs according to the provisions of this Act." This section applies to all persons who die intestate, and have a spouse surviving them. The distribution of the property is based on the rules of succession provided in the Act, which take into account the degree of relationship between the deceased and the claimants. The key judicial interpretation of this section is that the spouse has a prior claim to the property of the intestate, and is entitled to a share of the property.
