Section 92

Section 92 of the Indian Contract Act, 1872, deals with contracts that are voidable due to coercion. According to this section, a contract is voidable at the option of the party whose consent was obtained by coercion. The actual statutory language is: 'A contract is voidable at the option of the party whose consent was caused by coercion, as defined in section 15.' The section further explains that if the party whose consent was so caused has, after the cessation of such coercion, performed or ratified the contract, it shall not be voidable by reason of the coercion to which such party's consent was caused. Judicial interpretations have highlighted that coercion must be of such a nature as to interfere with the free exercise of the will of the party. The Supreme Court has also emphasized that the onus of proving coercion lies on the party alleging it.
