What does Section 188 of Companies Act say?

Any person who has been named as a director or as an intended director of a company in the articles of association of the company, or who has been named as a promoter of the company in any prospectus or in any advertisement issued by the company, or who has taken a part in the formation of the company, shall be deemed to be a promoter of the company.
