Where the Chief Justice or any other judge of the Supreme Court or of a High Court is satisfied that a person to be appointed as an arbitrator has declined to act, or is unable to act, or is dead or has become incapable of acting, or is mentally or physically incapable of acting, or is guilty of any misconduct or neglect of duty, the Chief Justice or such judge may, on the application of any party, appoint another person to act as an arbitrator.
